The San Bernardino Divorce Process

The process is started by filing and serving a petition for divorce on the other spouse.  The divorce petition can be filed in the San Bernardino Superior Court if either spouse has resided either in San Bernardino County for the past six months or California for the past six months and San Bernardino County for the past three months.  The other party then has thirty days to the divorce papers.  If the other spouse fails to timely respond, a default judgment may be entered awarding the Petitioner everything he or she asked for in the petition.  It is important to contact family law attorney and custody lawyer Richard McAndrew immediately if you served with family law papers.

An Order to Show Cause hearing is usually held shortly after the filing of the petition to make temporary orders regarding child custody, child visitation, child support, spousal support and property issues.  If the divorce involves custody of minor children, mandatory mediation will be held before the Order to Show Cause hearing to attempt to reach an agreement regarding child custody issues.  If the parties fail to reach an agreement, the mediator will submit a report to the court making custody and visitation recommendations.  In addition, emergency hearing may also be conducted if an urgent law problem develops. 

Family law settlement negotiations are generally conducted after temporary orders have been established and both parties have exchanged information and documentation regarding their financial situation.  Family law attorney and custody lawyer Richard McAndrew will attempt to resolve your case quickly by negotiating an appropriate divorce settlement on your behalf.  If the parties can reach an agreement, the settlement can be incorporated into a binding judgment which will resolve the case.  If the parties cannot reach an agreement, family attorney and custody lawyer Richard J. After the child custody, child visitation, child suuport, spousal support and property issues have been determined, the court will terminate the marriage months after the petition was filed.  At that time, the parties will be free to remarry.
