The most common criminal charge is DUI or drunk driving. Although drunk driving may seem like a very straightforward crime that is hopeless to defend, it is actually a very complex area of criminal law with a number of potential defenses. The police stop in the first place may not have been constitutionally valid. Further, after stopping you, the police may not have had probable cause to suspect that you were driving under the influence of alcohol. In addition, there are technical requirements relating to the breathalyzer which the police must comply with including requirements that the breathalyzer must be functioning properly, maintained and calibrated. In addition, the breathalyzer must be administered by a trained police officer. Further, the police are required to perform two breathalyzer tests within 15 minutes of each other and the results of the test must be within .01 of each other. In addition, both of the breathalyzer tests must be performed within three hours of the time you were driving.
